Abstract

This paper aims to describe the implementation of kafalah based on the Fatwa of the National Sharia Council (DSN-MUI) Number 11/DSN/MUI/IV/2000. In general, kafalah is a guarantee given by the insurer (kafiil) to a third party to fulfill the obligations of the second or borne party (makfuul 'anhu, ashil). On the basis of this understanding, there are at least three things contained by the kafalah, namely the ability to fulfill the rights that are the obligations of others, the ability to bring goods that are borne and the ability to present people who have obligations to others. Kafalah has been widely applied in Islamic financial institutions, such as Islamic banks on condition that they must comply with sharia principles, marked by the existence of a contract that legalizes the guarantees provided by sharia financial institutions. Therefore, the kafalah contract is included in the tabarru contract where all actions are based on mutual help, namely to eliminate human difficulties and provide convenience and solutions for humans in meeting needs.
